Terms and conditions of the online shop Manufaktura BetonU   § I. INTRODUCTION   1.The online shop manufakturabetonu.pl, operating at www.manufakturabetonu.pl (hereinafter referred to as „the Shop”) is operated by the company: Manufaktura Betonu Michalik Arkadiusz ul.Podbielowska 91b, 33-300 Nowy Sącz NIP: 734-248-12-07 tel. +48 694 485 085 2.The shop sells goods via the Internet. By making a purchase in the shop manufakturabetonu.pl, the Customer accepts the terms of these regulations.   § II. SHOP OFFER Concrete Manufactory   1.All prices presented on our pages are gross prices and do not include VAT (the company is not a VAT payer). 2.The terms and conditions of conducting promotional actions are each time specified in separate regulations. 3. The number of products for promotional sale is limited, therefore the sale takes place in the order of receipt of confirmed orders until the stocks covered by this form of sale are exhausted.   § III. RECEIPT OF ORDERS   Orders from customers are accepted through the website www.manufakturabetonu.pl. Orders can also be placed by e-mail or telephone. 2.The condition for the execution of the order is to provide your data, telephone number and e-mail address, allowing verification of the order placed. 3. Third In the order, the Customer makes: – the selection of the goods to be ordered and their quantities; – the designation of the delivery method and the delivery address and billing address (these may be different addresses); – the choice of payment method. 4. After placing an order, the customer receives an email with information about accepting the order for processing. 5. The contract of sale shall be concluded upon confirmation of acceptance of the order for execution by the Store.[1] 6. a bill is issued for each order. 7. The shop also sends the goods abroad (only after prior agreement on the cost of foreign shipment and after prior payment to the account or transfer payment PayPal).   § IV. CHANGE AND CANCELLATION OF THE ORDER   1.The customer can make changes to the order or cancel the order until it is completed (i.e. until it is sent for shipment). 2. The above changes can be made by phone or e-mail with the shop staff.   § V. FORMS OF PAYMENT   1. The customer can choose the following forms of payment for the ordered goods: – through a system of fast electronic transfers – Dotapy; – by bank transfer to an account; 2. The goods with delivery outside the territory of Poland can be paid only by bank transfer or on-line via fast electronic transfers.   § VI. DELIVERY AND PERFORMANCE   1. LAYING TIME is the time of realization plus delivery time.   2. Czas realizacji zamówienia podany jest przy każdym produkcie. This is the time that elapses from the acceptance of the order for execution, until the delivery of the ordered goods in the shop for dispatch, in the form of delivery chosen by the customer, with only working days (Monday to Friday) taken into account. 3. The order for goods with different lead times is sent after completion of the whole. 4. Realizacja zamówienia rozpoczyna się: – In the case of orders payable by fast transfer or traditional transfer – after the payment is credited to the account. 5/ Orders are delivered through a courier company, or Paczkomaty service to the address indicated by the Customer. The delivery time depends on the chosen delivery method: Kurier DPD – 1-2 dni robocze; Kurier Pocztex – 1-2 dni robocze; Kurier InPost – 2-3 dni robocze; 7. The cost of delivery is determined automatically and is visible in the shopping cart before placing an order.   § VII. RETURNS AND RECLAMATIONS   RULES FOR TAKING RETURNS 1 In accordance with the Act of 30 May 2014 about consumer rights (Journal of Laws of 2014, item 827 as amended), a consumer who has concluded a remote agreement may withdraw from it without giving any reason within 14 days from the date of delivery or release of the goods. For this deadline to be met, it is sufficient to send a statement of withdrawal 2. In the case of withdrawal from the contract Shop will return all payments made by the consumer, with the proviso that the costs of delivery to the consumer will be refunded to the amount corresponding to the cheapest shipping option available in the offer. 3. The consumer is obliged to return the goods immediately, no later than 14 days from the date of the declaration, and the consumer is obliged to pay all direct costs of returning the goods. 4. We would like to inform you that you may be liable for the deterioration of the returned goods. 5. The right of withdrawal does not apply to contracts where the subject matter of the performance is sound or visual recordings or computer programs supplied in sealed packaging, if it has been opened after delivery.   RULES FOR ACCEPTING COMPLAINTS 6. In the case of purchase of goods by persons who are not consumers within the meaning of the Act of 30 May 2014. about consumer rights, the warranty for physical defects of things is excluded (Article 556 § 1 of the Civil Code). In case of any defects in the goods, please contact the Shop by phone or e-mail. 7. The purchase of goods by persons who are consumers within the meaning of the Act of 30 May 2014. On consumer rights, the following principles apply. The shop shall be liable to the consumer for the goods sold if the defect is found within 2 years of their delivery. In case of defects in the goods, a complaint may be made in any form. The period for lodging a complaint is 1 year from the date on which the defect was found. The consumer may indicate in the complaint one of the following requests: replacement of the goods with a new one, repair of the goods, reduction of the price or withdrawal from the contract (only in case of a material defect). 8. Shop Manufaktura Betonu defines the principles of the Privacy Policy, informing customers about the issues of obtaining, processing and securing personal data. 2. By placing an order, the Customer agrees to the processing of his personal data for the purpose of the order and confirms their compliance with the facts. 3. The administrator of the personal data is Manufaktura Betonu Michalik Arkadiusz Michalik, Podbielowska 91b 33-300 Nowy Sącz NIP: 734-248-12-07 4. Company Manufaktura Betoneta stores the following personal data: name, surname, e-mail address, telephone number and address to which the shipment is to be delivered. This data is necessary to place an order. 5. customer data is collected solely for the purpose of ensuring the correct handling of the order. This data will be stored and properly protected against access by unauthorized persons, in accordance with the Act of 29 August 1997. on personal data protection (Journal of Laws of 2002, No. 101, item 926, as amended). 6. The customer may also agree to receive marketing materials from the store, including a newsletter of the store. 7. The customer has the right to inspect their personal data, to correct or delete them. 8. The legal basis for the Privacy Policy is the Personal Data Protection Act of 29 August 1997 (Dz. U. of 2002, No. 101, item 926, as amended).   § IX. FINAL PROVISIONS   1. In matters not covered by these Regulations, the provisions of the Civil Code and the Act on Consumer Rights shall apply. 2. These Rules of Procedure shall apply from 01.02.2018. 3. Orders placed before the date of implementation of changes are realized on the basis of the provisions in force on the date of the order.
